Housing Society Maintenance Charges: How to Calculate & Collect Them

Maintenance fee disputes are the single largest source of friction between apartment owners and society committees in India. Discover how to establish fair calculation formulas, sinking fund allocations, and automated collection systems.

Billing rules and maintenance calculation breakdown

Understanding Society Maintenance Charges

In any residential community, maintenance charges fund common area electricity, 24/7 security personnel, elevator AMCs, diesel generator fuel, housekeeping, landscaping, and water supply maintenance. Setting an accurate budget requires balancing ongoing operational expenditures (OpEx) with long-term capital repair reserves (CapEx).

The 3 Common Calculation Methods in India

1. Flat Rate (Equal Fee)

Every apartment pays the exact same monthly fee regardless of carpet area. Most common in societies where unit sizes are uniform (e.g., all 2BHK units).

2. Per Square Foot Model

Charges are multiplied by the super built-up or carpet area of each flat (e.g., ₹3.50/sq.ft). Larger 3BHK and 4BHK units pay proportionally more.

3. Hybrid (Bylaw Model)

Equal division of common service fees (security, lift, cleaning) plus per-sqft calculation for building repair and sinking funds.

Sinking Fund and Repair Reserve Rules

State regulations (including Maharashtra Co-operative Societies Act Model Bye-Law No. 67) mandate creating a Sinking Fund (typically 0.25% per annum of construction cost excluding land) and a Repair & Maintenance Fund (minimum 0.75% per annum). Modern software automates separate ledger accounting so reserve funds are never accidentally spent on operational shortfalls.

GST on Maintenance Charges: Know the ₹7,500 Rule

Under Indian GST regulations:

  • If the monthly maintenance charge per member exceeds ₹7,500 per month, GST @ 18% is applicable on the entire amount (if society's total annual turnover exceeds ₹20 Lakhs).
  • Statutory charges such as property tax, water tax, and electricity charges collected on actuals are exempt.
